Kirkuk, Aug. 12 (AKnews) – A legal advisor from the U.S. foreign ministry is looking into the obstacles that have so far hindered the implementation of the constitutional article 140, a Kirkuk official revealed on Wednesday.
Kirkuk Governate Press Secretary, Dler Samad announced that the U.S. Foreign Ministry’s advisor on legal issues would be working with chief officials in Kirkuk to shed light on the issues affecting the implementation of article 140. Samad also revealed that 600 of the 900 compensation checks due to those displaced had been issued.
Article 140 of the Iraqi constitution states that before a referendum over the disputed areas is carried out, measures should be taken to reverse the ‘Arabization’ policy employed by the Saddam Hussein administration during the Al-Anfal Campaign.
Thousands of Kurds returned to Kirkuk following the 2003 invasion of Iraq. The referendum that was initially scheduled to take place in November 2007 is to decide whether enough have returned for the area to be considered Kurdish.
Ongoing disputes between the Federal Government in Baghdad and the Kurdistan Regional Government in Erbil have so far prevented the referendum from taking place.
“The US legal advisor, Ibrahim Michael is dealing with the constitutional article’s legal platforms such as signed agricultural contracts, and land ownership documents, following talks with the Office Representative, Rash Sadiq furnished him with the necessary details”, Samad revealed.
With regards to the compensation checks for those who were displaced during the Al-Anfal campaign, Samad indicated, “we have received 150 of the 250 checks for Arab settlers, and 450 of the 700 checks for those returning to the region from exile”
The compensation payments form a necessary stage in the implementation of article 140 as they help to ensure the restoration of the region’s demography. It was agreed that each displaced Arab settler would receive a payment of 20 million Iraqi Dinars (ID), while Kurds returning to the region would receive 10 million ID.
