Political first : the government agrees to accede to the Convention on the Physical Protection of nuclear material

BAGHDAD - morning
Government spokesman Ali al-Dabbagh reasons for approval of the Council of Ministers a draft law on Iraq's accession to the Convention on the Physical Protection of Nuclear Material.

Dabbagh said in a statement issued by his office,


And received the "morning" a copy of it: "The cabinet decided to approve the draft Law on the accession of the Republic of Iraq to the Convention on the Physical Protection of Nuclear Material, adopted by the United Nations and referred to the House of Representatives on the basis of the provisions of Articles (61 / item first, and 80 / item II) of the Constitution ".

He added that the approval of the project comes to Iraq's fulfillment of the requirements to act transparently in this area in accordance with decisions of the government Iraq's accession to international conventions relevant to combating terrorism and the physical protection of nuclear materials and implement the recommendations of the committee formed to study the letter of the Secretary General of the United Nations for Iraq's implementation of UN Security Council resolutions in this regard and lifting of Security Council resolutions related to weapons of mass destruction on Iraq and ousting Iraq from the tutelage of Chapter VII, where the Convention aims to ensure international cooperation in the protection of peaceful and military nuclear power in order to avoid the dangers arising from use or unlawful use of and take the necessary measures to prevent crimes related articles nuclear and facilitate the safe transport them.
He explained that the Ministry of State for National Security Affairs, had already asked the State Consultative Council to show legal advice on accession to the Convention on the Physical Protection of Nuclear Material, the Board has audited the Convention.

And such advice was that the Ministries of Foreign Affairs, Defence and Interior and the State for National Security Affairs supports all acceding to the Convention.

And the Ministry of Science and Technology indicated that accession to the Convention contributes to the safety and security of nuclear and opens prospects for cooperation with Member States to obtain information and technical expertise as well as methods for secure and protected when you move the material or transit through the countries.

Dabbagh said the agreement was drafted by the representatives of (58) state has been adopted by the United Nations in the third of March 1980 and entered into force on the eighth of February 1987.

The agreement included several articles dealing with the physical protection of nuclear material. And all State Parties to the Convention it must take appropriate steps under its national law and consistent with international law to ensure the maximum extent practicable, during international nuclear transport and to provide protection at the levels set forth in the Convention and have take a decision whether or not to export unless they received assurances that the material will be protected during international nuclear transport.

And that these guarantees be the same for the import is not permissible for any State Party to allow the passage of its territory by land or in waterways or through airports or ports to States not party to this Convention were not the State Party has received assurances that these materials will be protected during international nuclear transport.

He added that the States Parties to the Convention to take appropriate decisions in accordance with their national laws to protect the confidentiality of any information obtained under the provisions of this Convention and to take necessary measures as it deems necessary to establish jurisdiction in the cases were committed by the offense in the territory of that State or on board ship or aircraft registered in that State when the alleged offender are nationals of that State or is located on its territory.

Dabbagh called the States parties to show maximum assistance in relation to criminal proceedings brought in respect of offenses relating to nuclear materials, including the provision of evidence in its possession. They also have to take appropriate steps to inform the other States that are involved in the theft or unlawful taking of nuclear material or credible threat thereof. The States Parties shall cooperate and consult with each other in order to obtain guidance on the design, maintenance and improvement of systems of physical protection of nuclear material in international transport.
